The Undiet Company Coaching Agreement

This Coaching Agreement ("Agreement") is entered into by and between The Undiet Company ("Coach") and the client ("Client").

1. Program Duration & Support:
The Program begins on the date of the Client's onboarding call with their coach and ends six months later. If the Client and Coach agree in writing to pause the Program, the end date will be extended by the length of the agreed pause.

The first 12 weeks are the active one-to-one coaching phase. For the remainder of the Program, aftercare consists of continued group access to the Undiet community only. Aftercare does not include ongoing one-to-one support, although the Coach may offer occasional one-off check-in calls at its discretion.

2. Payment Plan & Program Commitment

The Client is purchasing the full six-month Program, not separate monthly services. Any payment plan is only a method of paying the total Program fee and does not make the Program a month-to-month arrangement. If the Client withdraws, stops participating or stops using the Program before it ends, all remaining instalments remain payable, except where this Agreement or Australian Consumer Law gives the Client a right to cancel or receive a refund.

The Client agrees to adhere to the agreed-upon payment plan. In the event of non-payment, the Coach reserves the right to take legal action to recover outstanding fees and may enlist the services of a debt collector for resolution. Failure to make timely payments may also result in the termination of coaching services.

3. Refund Policy & Guarantee Eligibility:
During this program, the Client has a guarantee backing them. That is…

"If this program doesn't help you to stop binge eating and improve your control over food, we'll give you a full refund."

Requests for this guarantee will only be granted if all the following conditions are met: the Client has completely finished the initial 12-week one-to-one coaching phase, shown up to all calls, actively applied coaching tools and advice, completed assigned courses, and has still not stopped binge eating. If any of these have not been done, the Client will not have met the criteria of the guarantee and will therefore not be eligible for a refund.

If all of the criteria have been met and the Client is eligible for the guarantee, the Client must reach out and make it known that they wish to enact the guarantee and receive a refund.

The Client can only request a refund within 30 days of finishing the initial 12-week one-to-one coaching phase. The included aftercare period does not extend or restart this 30-day period.

If the Client purchases an optional continuation one-to-one coaching package after the initial 12-week coaching phase, the Client will no longer be eligible to make a claim under the voluntary results guarantee. This does not limit any rights the Client has under Australian Consumer Law.

4. No-Show Policy:
Missed 1:1 calls without prior notice or rescheduling within 8 hours of the call will result in the forfeiture of that specific call.

5. Non-Medical Disclaimer:
Although the Coach is a qualified Nutritionist, Dietitian or Naturopath, they should not be treated as a medical professional. The coaching provided is not a substitute for professional medical advice. Clients are encouraged to consult with a healthcare provider for any serious medical concerns.

6. Limitations Of Liability:
The Coach shall not be held liable for any health-related outcomes or consequences arising from the coaching. The Client releases, indemnifies, and holds the Coach harmless from any claims, damages, or liabilities related to health matters, including but not limited to injuries, illnesses, emotional distress or exacerbation of existing conditions.

6. Self-Led Commitment:
This program is self-led, and the Client is responsible for actively participating and implementing the provided tools and resources into their daily lives.
